Ummm....what else would you think it is???
You think it's hardware, built into the CPU chip??? If that is so, then how can different manufacturers use the SAME CHIP for different operating systems (e.g., Linux, Mac/OS, WindowsXP, WindowsVista, Windows2000, and and and and...).
HINT: There are only two choices, hardware and software. And it isn't hardware.

i know its a software...
but when u ask this question to ppl, most of them struggling to say the clear cut reponse. i think this is bcoz most of us dont use the word "software" when talking about the operating system.

Just as we don't use the word vehicle all the time when referring to a car. That still makes a car a vehicle.... ;-)

Why do cops say "step away from the vehicle" if they want you to move away from your car?
Lingo....
This is a programmer's forum; not necessarily the local poetry and language club. Is this really relevant?
The fact that an OS is called an OS still makes it software. I guess that term is used and not "software" because it better describes what it is. If there was a better term for "photo editing software", I am sure that would be used instead.
