Depending on your XSLT processor then the following xsl:output instruction will produce the DOCTYPE declaration:

Code:
<xsl:output method="html" version="5.0" />
outputs

Code:
<!DOCTYPE HTML>
Tested in Saxon 9.3.0.2

Yes, this basic level of support for HTML5 was added to Saxon 9.3. There's nothing about HTML5 serialisation in the XSLT spec, of course; and this DOCTYPE feature is the only thing Saxon does specially for HTML5. The WG is looking at what else might be needed.
